What is a BOC-3 application?

BOC-3 application is an important and mandatory process required for transportation and logistics businesses before they can commence their operations in the United States. All brokers, motor carriers, freight forwarders, and logistics companies seeking to operate in interstate transportation and commerce are required to have their BOC-3 form filed by authorized BOC-3 agents. Without this form, you will not be able to operate in any U.S. state. Having this form is crucial for ensuring the smooth operation of commerce between states.Can i file my own BOC 3?

Individuals are not able to file these forms on their own. BOC-3 forms are filed by designated BOC-3 agents, who are also called process agents. All freight forwarders, brokers, and motor carriers are required to hire a BOC-3 agent. Designating a process agent, whether a person or a company, is required by the BOC-3 form. This allows them to receive legal documents on your behalf. Only once you become a registered process agent will you be able to file your own form. 

BOC-3 process agents 

Required by FMCSA, process agents are designated representatives who have the legal authority to receive and process legal documents on your behalf. They are professionals with strong knowledge and understanding of FMCSA regulations. BOC-3 agents are required to manage and forward legal documents of high importance. They also serve as liaison between freight companies and FMCSA. This means they should demonstrate strong professionalism in data privacy and compliance with law regulations.  

As individuals cannot file these forms on their own, they should hire BOC-3 agents who can complete the whole process on their behalf. BOC-3 agents are the legal point of contact in each U.S. state where their business operates. Apart from all the professional skills that they possess, they should be able to track multiple filings and maintain a broad nationwide network of professionals and representatives.  

Does BOC-3 expire?

BOC-3 form does not expire. It remains active as long as the logistics company’s authority is valid. There are several cases when BOC-3 forms must be submitted again, such as when the BOC-3 agent changes. In such cases, FMCSA requires updated records so that the legal documents are sent to the current agent. Another circumstance under which BOC-3s need to be updated is when the courier’s operating authority expires or is revoked.

Brokers, motor carriers, and freight forwarders are not required to renew their BOC-3 forms. However, they are required to keep them active and make sure they adhere to FMCSA regulations. It is very important to maintain validity and keep information up to date. Keep in mind that any change in credentials needs to be reflected in your new BOC-3 form accordingly.  

To resume your operating authority once it gets revoked or becomes inactive, you need to first rectify the issue that led to revocation. This means refiling your BOC-3 and updating your insurance. Next steps are to submit a request for reinstatement and pay the necessary fee. After you complete these steps, you might need to wait several business days before your request is approved. Completing these steps enables you to operate again and cooperate with other logistics entities.
